An inspection by the Chief Labour Inspectorate. What does the Labour Inspectorate require: Who is authorised to carry out workplace environment measurements, and what documents do you need?
Every inspection carried out by the Executive Agency ‘General Labour Inspectorate’ (EA GIT) begins with a review of the mandatory health and safety at work documentation.
Among the most important documents that inspectors check are протоколите от измервания на факторите на работната среда и електробезопасността.
However, many employers are asking themselves: Who is authorised to carry out these measurements, and what are the regulations that require them to do so?
In this article, we will look at the legal requirements and the list of documents you need to prepare to ensure your inspection goes smoothly.
The role of the Supervisory Authorities (SA) under the Occupational Health and Safety Act
According to Закона за здравословни и безопасни условия на труд (ЗЗБУТ), измервания на параметрите на работната среда не могат да бъдат правени с произволни уреди или от несертифицирани лица.
These specific activities are carried out exclusively by specialised legal entities, officially known as Орган за контрол от вид А, Б или С (ОКС). In order to be authorised to operate, these bodies must hold official and valid accreditation from Bulgarian Accreditation Service (BAS).
Important: Reports and certificates issued by companies without valid accreditation from the Bulgarian Standards Agency (BSA) have no legal validity and are not recognised by the Labour Inspectorate.
On what grounds does the Labour Inspectorate require these documents?
The inspectors’ requirements are not arbitrary – they are based on strict government regulations:
-
- Regulation No. 7 on the minimum requirements for healthy and safe working conditions in the workplace and when using work equipment. It requires employers to maintain optimal levels of physical factors in the workplace.
- Regulation No. 16-116 on the technical operation of electrical installations. It regulates the mandatory periodic measurements of electrical installations and equipment (such as impedance and earthing) for the safety of personnel.
List of documents and minutes that you must submit
During an inspection, the employer is obliged to provide valid certificates and reports, issued by an accredited inspection body, for the following components:
-
- Microclimate: Official measurements of temperature, humidity and air velocity in the workplace (during the summer and winter months).
- Lighting: Documents proving that the levels of artificial and natural lighting comply with the standards for the specific activity.
- Noise: Measurements of noise levels in the workplace, where the nature of the work and the equipment generate such noise.
- Electrical measurements (Electrical safety): Reports on the earthing of enclosures, the serviceability of the lightning protection system and the measurement of the impedance of the ‘phase-protective conductor’ circuit.
